These terms cover consumer purchases through CurryKits.com. Please read them before ordering and keep a copy. Nothing in these terms takes away your statutory consumer rights.

1 About us

CurryKits.com is operated by CURRYKITS LTD, trading as CurryKits (we, us or our). Company number: 16415269. Registered office and correspondence address: 46 Ennerdale Crescent, Nuneaton, CV11 6HZ, United Kingdom.

Contact us at sales@currykits.com or by telephone or WhatsApp on 07951 842205. You can also write to the address above. Separate terms may be agreed for wholesale or trade purchases. Orders through marketplaces are also subject to the applicable marketplace terms and your statutory rights.

2 Ordering and acceptance

Check your basket, product choices, delivery address and contact details before paying. Your order is an offer to buy. Our initial order email acknowledges receipt. We accept your order and form the contract when we send your dispatch confirmation. We will provide a copy of the applicable terms in a form you can keep.

Before acceptance, we may decline an order if payment fails, stock is unavailable, delivery is unavailable or we reasonably suspect fraud. If a price or description is wrong, we will explain the error and ask whether you wish to proceed on the corrected basis. We will not charge more without your agreement. If we cannot accept your order, we will promptly refund any payment for it.

3 Prices and payment

Prices are in pounds sterling and include applicable taxes. Delivery and optional gift-service charges are shown before payment. Use one of the payment methods offered at checkout. Later price changes do not affect an accepted order. Any conditions for a discount or promotion will be displayed with the offer.

4 Our products

Your chosen product description explains the contents, quantities and any choices available. Curry kits require the additional ingredients stated in the recipe. Prepared dishes, serving suggestions and props in photographs are not included unless expressly listed.

Spice colour and natural ingredients may vary slightly between batches. Packaging design may change, but products must still match their description. We will ask for your agreement before making a material substitution; you do not have to accept it and may receive a refund for the affected item.

5 Dispatch and delivery

We aim to prepare and dispatch orders promptly, normally within 1–2 working days, unless a different dispatch period is clearly stated before you order. Dispatch means handing your parcel to the delivery provider; it is separate from the time the provider takes to deliver it. Working days are Monday to Friday, excluding public holidays in England.

Dispatch and delivery times are estimates unless we expressly offer or agree a guaranteed service or delivery date. We work hard to send orders on time, but delivery can be affected by courier disruption, severe weather, transport problems, industrial action and other circumstances outside our reasonable control. Busy periods may also affect processing times. We will communicate any known extended dispatch estimate before purchase.

Delivery services, destinations, charges and estimated transit times are shown before you pay. Royal Mail Tracked 24 and Tracked 48 service names do not, by themselves, mean delivery is guaranteed within 24 or 48 hours. A guaranteed service will be expressly identified as such.

The delivery estimate depends on the service you select at checkout. The following UK transit times start after dispatch and are additional to our normal 1–2 working day dispatch estimate:

Royal Mail Tracked 24: estimated 1–2 working days after dispatch.

Royal Mail Tracked 48, including free Tracked 48: estimated 2–3 working days after dispatch.

Royal Mail Special Delivery: next working day after dispatch, subject to the carrier’s acceptance cut-off, postcode exceptions and applicable guarantee conditions. Our processing time is additional; this does not promise delivery the day after you order.

For international services, the estimate depends on the destination and selected postal service. Check the information shown for your option at checkout; if no numerical estimate is shown, contact us before ordering for a destination-specific estimate. Customs clearance and local delivery disruption can add time. Any expressly agreed delivery commitment and your statutory rights still apply.

If an order is needed for a birthday, Christmas or another essential date, tell us before ordering so we can discuss whether delivery is achievable. Choosing a faster estimated service does not itself guarantee a date. This does not affect your rights where timely delivery is essential under consumer law.

If your order is delayed or missing

If we become aware of a delay affecting your order, we will contact you as soon as reasonably possible, explain the position and take reasonable steps to reduce its impact. Contact us if the estimate has passed or tracking appears incorrect. We will investigate with our delivery provider; you do not have to pursue the provider yourself.

We must deliver without undue delay and, unless we have agreed a different delivery period, within 30 days after the contract is made. If we miss an agreed delivery deadline or the applicable 30-day period, you can require delivery within a further period appropriate to the circumstances and cancel if we miss it. You may cancel immediately if we refuse delivery, or timely delivery was essential in the circumstances or you told us before the contract was made that it was essential. We will refund payments due without undue delay. External disruption does not remove these rights.

Delivery details and responsibility

Please supply an accurate address and contact us promptly about errors. If an incorrect address or failure to collect causes a parcel to return, we may ask you to cover reasonable actual redelivery costs, explained and agreed in advance. We will not charge for redelivery caused by our error.

For delivery services we offer or arrange, the goods remain our responsibility until physically received by you or a person you nominate. If there is a dispute about an alleged delivery or safe-place delivery, contact us so we can investigate. A tracking status alone does not remove your statutory rights.

6 Cancelling or changing an order

Contact us promptly if you want to change or cancel. We will try to help before dispatch. Once dispatched, we may be unable to change the parcel, but any legal cancellation and return rights still apply.

For eligible goods, you may change your mind and cancel from ordering until 14 days after the day you or your nominated recipient receives them. If an order is delivered in separate parts, this normally runs from receipt of the last part. Tell us clearly by email, telephone, WhatsApp or post. You may use the cancellation form in section 12, but do not have to.

The change-of-mind right does not apply to goods liable to deteriorate or expire rapidly, or to sealed goods unsuitable for return for health-protection or hygiene reasons once unsealed after delivery. It also does not apply to goods clearly personalised or made to your specifications, or goods inseparably mixed with other items after delivery. We will identify relevant exceptions before purchase.

We do not exclude every food product from cancellation. Opening an outer delivery box or hessian bag does not itself remove your rights if the relevant food seals remain intact. Adding a gift message or gift wrapping does not automatically make otherwise standard goods personalised or non-returnable. These exceptions never remove your rights over faulty, unsafe, damaged or misdescribed products.

7 Returns and refunds after cancellation

Send eligible goods back within 14 days after telling us you are cancelling. Returns can be sent to the correspondence address in section 1. Contact us for practical instructions if needed; prior authorisation is not a condition of exercising a legal cancellation right. Pack items securely and keep evidence of postage.

You pay the direct return postage for a change-of-mind return. We pay reasonable return costs where goods are faulty, damaged, incorrect or not as described. We may make a lawful deduction for diminished value caused by handling beyond what is needed to establish the goods’ nature, characteristics and functioning. There is no cancellation administration or restocking fee.

For a valid cancellation of the whole order, we refund the price paid and the cost of our least expensive standard outward delivery option. The extra cost of a premium service is not refundable under the change-of-mind rules. For a partial cancellation, delivery charges are refunded where legally required.

Refunds are made without undue delay using the original payment method, unless you expressly agree otherwise, without a refund fee. Where goods must be returned and we have not offered collection, we may withhold the refund until we receive them or evidence of return, whichever is earlier, and will refund within 14 days of that point. Otherwise we refund within 14 days after being told of your cancellation.

8 Faulty damaged or incorrect products

We must supply goods of satisfactory quality, fit for purpose and as described. Contact us if your order has a problem. Your order number, batch details and photographs may help us resolve it, but we will accept other reasonable evidence and do not impose a 24-hour or 48-hour claim deadline. Do not consume food you reasonably believe is unsafe.

Your legal remedies may include rejection and a refund, replacement or a price reduction. The short-term right to reject is normally 30 days, although it may be shorter for goods reasonably expected to perish sooner. Further rights may continue afterwards. Contact us to arrange any necessary return at our cost. The change-of-mind exclusions above do not apply to these remedies.

9 Ingredients allergens and storage

Read the ingredient, allergen and dietary information on the product page before ordering and on the packaging before use. If information is missing, unclear or appears inconsistent, contact us before ordering or consuming it. We must provide accurate information; asking you to check a label does not reduce that duty.

Follow the storage, use-by or best-before information and preparation instructions for each component, including any requirements after opening. Store and cook your added fresh ingredients safely. Heat ratings and suggested serving sizes are guides; personal tolerance and the ingredients you add affect the finished dish.

10 Gift options

Gift wrapping and gift-message options are available only where shown. Check the message and recipient’s address carefully. Contact us promptly if either needs correcting; amendments may not be possible once prepared or dispatched. Any optional charges are displayed before payment. Gift options do not remove the cancellation or faulty-goods rights explained above.

11 Liability privacy and disputes

We are responsible for foreseeable loss or damage caused by our breach of contract or failure to use reasonable care and skill. Loss is foreseeable if it is an obvious consequence or if you and we knew it might happen when the contract was made. Products sold under these consumer terms are for domestic and private use; we do not accept liability for business losses.

Nothing in these terms excludes or limits liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, defective products where the law imposes liability, or any liability or consumer right that cannot lawfully be excluded or limited. The delivery estimates above do not excuse our own breach or remove remedies provided by law.

Our Privacy Policy explains how personal information is used. Accepting these purchase terms does not sign you up to marketing. Any optional marketing preference is separate.

Please contact sales@currykits.com with a complaint so we can try to resolve it. These terms are governed by the law of England and Wales. Consumers elsewhere retain the mandatory protections available under applicable law. You may bring a claim in the courts of England and Wales, or in Scotland or Northern Ireland if you live there, and retain any other mandatory rights to use your local courts.

Updates apply to future orders. Your order is governed by the version provided when you placed it, unless we agree a lawful change with you. If a provision cannot be enforced, the remaining provisions continue where they can operate fairly and lawfully.
